APPELLATE PRACTICE
The appellate practice group represents clients during the briefing and argument of a case to the Nevada Supreme Court and Nevada Court of Appeals, as well as the federal Ninth Circuit Court of Appeals. In most cases, our appellate group’s work includes client representation beginning long before the briefs are filed. We regularly counsel clients and trial attorneys on the proper presentation of evidence in the underlying litigation to properly present appellate issues in a future appeal. This preparation includes guidance on drafting jury instructions, trial motions and arguments to the Court. This service is invaluable in high-value and complex litigation as it secures the basis for preserving a successful appeal.
When practicing before the Supreme Court or Court of Appeals, we can focus on what the members of the Court will find most persuasive based on its prior decisions and the standard of review for the issues. The Appellate Practice Group relies on extensive litigation and trial experience as well as excellent writing, analytical, and oral advocacy skills needed to evaluate a potential appeal or whether an appeal is in the best interest of the client. After retention, our appellate attorneys present the client’s case in the most compelling manner to the Court.
Services the Appellate Practice Group provides to the Firm’s clients include handling all aspects of appeals and writs in both state and federal courts, handling all aspects of judicial review of agency actions in both state and federal district courts, and supporting litigation counsel during trial to ensure that issues are properly preserved for a future appeal.
